CONTEST RULES

The « OCTANE 7.0 – Snowboard » contest (the « Contest ») is organized by TRIANI Group (the “Contest Organizer”). It takes place at all participating COUCHE TARD stores and opens on November 9, 2021 at 12:00 a.m. Eastern Time ("ET"), and closes on December 6, 2021 at 11:59:59 p.m. ET (the "Contest Period").

ELIGIBILITY

The Contest is open to all persons legally residing in Quebec and having reached the age of majority in their province or territory of residence at the time of their Entry (an "Eligible Entrant").

EXCLUSIONS: The employees, agents and/or representatives of the Contest Organizer, its affiliates, Participating Couche-Tard, non-participating affiliated grocers, Triani Group ambassadors and influencers, advertising agencies or any party involved in the administration of the Contest (the “Affiliated Parties”), as well as, respectively, any person with whom an Excluded Entrant is domiciled or any member of their immediate family (each an “Excluded Entrant”). For the purposes of the Contest Rules (the “Rules”), the term “immediate family” includes the father, mother, brother, sister, child, husband, wife, or common- law partner of an Excluded Entrant. For the sake of clarity, an Eligible Entrant who is not an Excluded Entrant is hereinafter referred to as an “Entrant”.

Each Entrant must enter exclusively on their own behalf and act for their sole personal benefit.

HOW TO ENTER

At participating Couche Tard stores, when the Participant purchases two (2) Octane 355ml cans of Octane Regular, Octane Frost and Octane Melon sour; these will be scanned, and the potential winners will be randomly selected by the cash register system. Winners will receive a winning coupon at checkout with their purchase and must call 450-621-5255 # 247 or email Groupe Triani at info@triani.ca to claim their prize by January 10, 2022 at 12:00 PM ET.

NO PURCHASE ENTRY – NO PURCHASE REQUIRED

To enter the Contest without making a purchase, you must write an original handwritten letter of one hundred (100) words or more explaining why you like to win a snowboard. Please provide your letter in an envelope addressed to the offices of the Contest Organizer, located at 901 rue des Forges, Terrebonne (Québec) J6Y 0J9, with the name of the contest, Attn: OCTANE 7.0 – Snowboard Contest (the “No Purchase Entry Request”). The No Purchase Entry Request must be received by the Contest Organizer no later than the last day of the Contest Period. Given the variability of the mail delivery schedule, the time of receipt for an Entry will be determined at the sole discretion of the Contest Organizer.

Limit of one Non-purchase Entry Request in the Draw per person and /or adress.

PRIZES

A total of fifty-three (53) Prizes (as defined) are available to be won in this Contest with a total approximate value of two thousand dollars (CAD $2 000).

GRAND PRIZE

There are three (3) Grand Prizes available to be won in the Contest (“Grand Prize” individually and “Grand Prizes” collectively). Each Grand Prize consists of one (1) Octane 7.0 snowboard with an approximate retail value of five hundred dollars ($ 500 CAD); an approximate total value of one thousand five hundred dollars ($ 1,500 CAD).

SECONDARY PRIZES

A total of fifty (50) Secondary Prizes will be awarded in this contest (“Secondary Prize” individually and “Secondary Prizes” collectively), for a total value of fifty dollars ($ 500 CAD). Each Secondary Prize consists of the delivery of one (1) COUCHE TARD gift card valued at ten dollars ($ 10).

Grand Prizes and Secondary Prizes are collectively referred to as a “Prize” or the “Prizes”.

PRIZE NOTES

The Prizes may not be identical to photos and images used in advertising and promotional materials for the Contest, including print advertisements, websites, and electronic banner advertising. Each Prize must be accepted (i) “AS IS” WITHOUT ANY WARRANTY OF ANY KIND, either express or implied, and (ii) may not be modified, transferred, assigned, or exchanged for cash (unless expressly authorized by the Contest Organizer at its sole discretion). The Prize will be awarded only to the Eligible Entrant. No substitution of a Prize will be possible except at the discretion of the Contest Organizer. The Contest Organizer reserves the right, at its sole discretion, to substitute any Prize or portion thereof with another prize of equal or greater value.

DRAW AND AWARDING OF PRIZES

The winners will be published via Triani Group social networks during the month of February 2022. PRIZE CLAIM
BEFORE BEING CONFIRMED AS A WINNER, the Selected Entrant must:

  • -  Call 450-621-5255 # 247 or write an email to the Triani Group at info@triani.ca before January 10, 2022 at 12:00 p.m. ET;

  • -  Correctly answer, unaided, a mathematical skill-testing question

  • -  Duly complete and sign the Prize Release Form, (the “Release Form”) and return Release Form

    within fort-eight (48) hours of receipt of the aforementioned Form, in accordance with the

    instructions provided by the Contest Organizer;

  • -  Consent to his/her name, address, voice, image, statements in connection with the Contest, and

    any photograph, video, audio and/or video recording, being published, reproduced, or otherwise used by or on behalf of the Contest Organizer for publicity purposes or other promotional or commercial use by or on behalf of the Contest Organizer, in any media, future or existing,

including print, broadcast, television, and the Internet, without further notice, additional

compensation, or right of inspection;
- Provide photo identification upon request.

If the Selected Entrant a) incorrectly answers the mathematical skill testing question, b) fails to return the duly completed and signed Release Form within the prescribed period, c) fails to accept (or refuses to accept) the Prize as awarded for any reason, and/or d) is found to have violated these Rules (as determined by the Contest Organizer at its sole discretion), they will be disqualified (and will forfeit the Prize). Prizes will be forfeited and not awarded.

Limit of one (1) Prize per Selected Entrant and /or adress. CHANCES OF WINNING

The odds of winning a prize depend on the total number of two (2) 355mL Octane 7.0 cans purchased at one time during the Contest Period.

TERMS AND CONDITIONS

All Entries become the property of the Contest Organizer.

The Contest is subject to all applicable federal, provincial, and municipal laws and regulations. The decisions of the Contest Organizer are final and binding in all matters related to this Contest, including any decision on the validity or disqualification of Entries or Entrants. By entering this Contest, you agree to be legally bound by the terms and conditions of these Rules. ANYONE FOUND TO HAVE VIOLATED THESE RULES FOR ANY REASON MAY BE SUBJECT TO DISQUALIFICATION AT THE SOLE AND ABSOLUTE DISCRETION OF THE CONTEST ORGANIZER AT ANY TIME.

By participating in this contest, all participants agree to be bound by these participation rules. Failure to comply with one of the conditions mentioned in the above paragraph or any other condition provided for in these participation rules, the participation of the selected person will be canceled.

If, due to production or printing errors or any unforeseen error, a number of prizes greater than the number stated in these Official Contest Rules is claimed, in no event will the Contest Organizer be liable. additional prizes exceeding the number of prizes indicated in these Official Rules.

The decisions of the Contest Organizer, the Contest Sponsor or the Contest judges are final and entrants agree to abide by all instructions and decisions made by the Contest Organizer, the Sponsor or the Contest judges. competition. The Contest Organizer, and or the Contest Sponsor, are not responsible for any loss, damage or claims arising from any awarded prizes or the contest. By participating in the contest, the contestant releases the Contest Organizer and / or the contest sponsor, its affiliates and associates, its advertising and

promotion agencies and their respective agents, officers, shareholders, employees, successors and assignees from all liability (collectively, the “Contest Entities”) for any injury, loss or damage of any kind arising out of the Contest or the acceptance, possession, use or misuse of any prize won.

Without limiting the exclusions herein, and for the sake of clarity, the Contest Entities assume no responsibility for: (a) any inaccurate or erroneous information caused by any equipment or programming associated with the Contest or any technical error or human that arises in the application of the contest or in the complaints process; (b) any communication problem, theft, destruction, alteration or unauthorized access to entries; (c) any technical problem or failure of telephone networks or lines, online computer systems, servers, service providers, computer hardware and software, or any email not routed due to technical problems with any website or Internet congestion; and (d) any damage caused to the computer of the participant or any other person as a result of the downloading of the documents relating to the contest. In the event that the contest cannot be held as planned for any reason whatsoever, including computer viruses, bugs, sabotage, unauthorized interference, fraud, technical malfunctions or for any other reason beyond the control of the contest entities, likely to compromise the administration, security or the smooth running of the Contest, the Contest Organizer and / or the Contest Sponsor reserve the right, at their discretion, to terminate or postpone the Contest, in whole or in part, without notice, or to modify it in any way, subject to the consent of the Régie des alcools, des courses et des jeux (the “Régie”).

The Contest Organizer and or Sponsor may, in their sole discretion, exclude any person from this Contest and any future promotion with or without notice if, in their sole discretion, the Contest Organizer and / or Sponsor determines that such person engages in fraudulent, potentially fraudulent, or non-compliant practices, or in any practice contrary to these rules or generally incompatible with the planned conduct of the contest, or if this person acts with the aim of annoying, abusing, threaten or harass the Contest Sponsor, its agencies, other entrants or any other person.

ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE OR HARM THE LEGITIMATE CONDUCT OF THIS CONTEST REPRESENTS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND, IF APPLICABLE, THE CONTEST ORGANIZER AND OR THE SPONSOR RESERVE THE RIGHT TO REQUEST AND REQUEST CLAIM ANY DAMAGES PROVIDED FOR BY LAW, INCLUDING COMMITTING CRIMINAL PROCEEDINGS.

The Contest Organizer reserves the right, subject only to the approval of the Régie des alcools, des courses et des jeux (the “Régie”) in Quebec, to withdraw, amend, or suspend this Contest (or to amend these Rules) in any way, in the event of an error, technical problem, computer virus, bug, tampering, unauthorized intervention, fraud, technical failure, or any other cause. Any attempt to deliberately damage any website or to undermine the legitimate operation of this Contest (at the Contest Organizer’s sole discretion) is a violation of criminal and civil laws. Should such an attempt be made, the Contest Organizer reserves the right to seek remedies and damages to the fullest extent permitted by law. The Contest Organizer, with the consent of the Régie, reserves the right to cancel, modify, or suspend this Contest, or to amend these Rules in any way, in the event of any accident, printing error, administrative error, or other error of any kind, or for any other reason, without prior notice or obligation. Without limiting the generality of the foregoing, the Contest Organizer reserves the right, at its sole discretion, to

administer another proficiency test, as it deems appropriate based on the circumstances, and/or to comply with any applicable law.

The Contest Organizer reserves the right, at its sole and absolute discretion, to change, without notice, the Contest deadline or any of the dates set out in these Rules, to the extent necessary, for the purposes of verifying the compliance of any Entrant or Entry in accordance with these Rules, or due to technical problems or under any circumstances that, in the view of the Contest Organizer and at its sole discretion, may affect the proper administration of the Contest in accordance with these Rules, or for any other reason.

Quebec Residents: Any litigation respecting the conduct or organization of a promotional contest may be submitted to the Régie for a ruling. Any litigation respecting the awarding of a Prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.

The name of the Contest winners will be visible on the TRIANI Group's social networks no later than sixty (60) days following the end of the Contest or December 6, 2021.

In the event of a discrepancy or inconsistency between the terms and conditions of the French version of these 9 Rules and any disclosures or other statements contained in any Contest-related materials, including the website, the English version of these Rules and/or television, print or online advertising at the point of sale, the terms and conditions of the French version of these Rules will prevail to the fullest extent permitted by law.

By entering this contest and being declared a winner, the winner consents to the Contest Organizer and / or the Organizer using their name, place of residence, voice, statements and photograph or any other image, without compensation or notice, to for advertising and information purposes in any media or format (including the Internet), current or future, and in perpetuity, with respect to this contest or any similar contest in the future.

The invalidity of any provision of these Official Rules or the failure to apply them shall not affect the validity or enforceability of any other provision. If any provision is found to be invalid, unenforceable or illegal, these Official Rules shall remain in effect and shall be construed in accordance with the terms, as if the invalid or illegal provision were not part hereof.
