Couche-Tard Connecté Store Terms and Conditions

Alimentation Couche-Tard Inc. welcomes you to the Couche-Tard Connecté Store.

Before you use the Couche-Tard Connecté Store feature of the Couche-Tard app (the “app”), or enter the Couche-Tard Connecté Store (together with the Couche-Tard Connecté Store feature of the app, collectively, the “Connecté Store”), please read these terms and conditions of use (the “Terms and Conditions”) carefully. These Terms and Conditions include or incorporate provisions such as conditions of sale, limitations of liability, and other provisions that may limit your rights.

Your use of and entry into the Connecté Store are subject to the following Terms and Conditions and all applicable laws. These Terms and Conditions incorporate the Couche-Tard Privacy Policy (“Privacy Policy”) and the Couche-Tard Terms of Use (“Terms of Use”), and any other applicable policies or terms posted on our website or available through this app from time to time. Where those policies or terms refer to the “Site”, for the purposes of applying those policies and terms in the context of these Terms and Conditions, the Connecté Store is the Site. By using the Couche-Tard Connecté Store feature of the app or entering the Couche-Tard Connecté Store, you accept and agree to be bound by these Terms and Conditions. If you do not agree with any of the Terms and Conditions, please do not use or enter the Connecté Store.

The terms “we”, “us”, and “our” used in these Terms and Conditions refer, collectively, to Alimentation Couche-Tard Inc. and its affiliates, subsidiaries, divisions, successors and assigns and their respective employees, mandataries and agents.

If you do not comply with any of these terms, we may refuse to allow you to use or enter the Connecté Store.

Account and Methods of Payment

To enter and use the Connecté Store, you must create an account within the app for which certain personal information and payment card information are required. We use third party payment processor service providers to effect charges onto your payment card. Any personal information we collect, use or disclose for the purposes of maintaining the account and managing your Connecté Store experience will be handled in accordance with our Privacy Policy.

You must add at least one payment method to your account. If you add more than one method of payment to your account, you must select one of those methods as the default. We reserve the right to stop accepting any permitted payment method at any time in our sole discretion.

You are entirely responsible for maintaining the confidentiality of your account and your password, for restricting access to your account, and for any and all activity that occurs under your account as a result of your failure to do so.


Prior to each entry you make to the Connecté Store, as a mutual convenience for both parties, we will withhold a portion of the credit available through your default method of payment in the amount of $1, also known as an “authorization hold” or a “pre-authorization”.

If we encounter a problem with your default method, we may pre-authorize any other method of payment associated with your account.

Our pre-authorization of your method of payment, default or otherwise, does not create a limit on the amount you may spend in the Connecté Store, and in no way constitutes an agreement or obligation on our part to limit the amount we may charge you in connection with Connecté Store purchases to the pre-authorized amount. You are obliged to pay, and agree that we may charge you, for the sum total due in respect of items selected by you in accordance with the section entitled “Connecté Store Purchases”, below.

The amount withheld in virtue of the pre-authorization, or any portion thereof not absorbed by your purchases, will remain on your card for the period of time specified in the cardholder agreement between yourself and the issuer of the payment card you selected as your method of payment. Typically, this will be less than seven business days but may be longer. We encourage you to review the terms of your cardholder agreement.

Connecté Store Purchases

We use technology in our Connecté Store to provide you with a convenient shopping experience. This technology provides you with access to the Connecté Store, determines when you or your guests have selected items for purchase, and charges you for the items selected when you exit the Connecté Store.

If you decide that you do not wish to purchase a selected item before leaving the Connecté Store, you must leave it in the Connecté Store in a prominent place in order for the Connecté Store technology to determine that you no longer wish to purchase that item. If you are uncertain as to where to place the item in order to ensure the ability of the Connecté Store to make this determination, you may always return the item to the same location from which it was taken. If you do not place or return the item in this manner it may be deemed selected and you will be charged for that item when you exit the Connecté Store.

By exiting the Connecté Store with items that you and your guests have selected, you agree to be charged for those items and for any additional amounts (including any taxes) as may be applicable in connection with your purchase, using the payment method you have selected in the Connecté Store feature of the app, and a legally binding contract will be in place between you and us with respect to those items.

We will send you a receipt that will be accessible to you within the Connecté Store feature of the app. Receipts will remain accessible in accordance with our retention policies or as otherwise required or permitted by law.

Refunds and Exchanges

The law gives you certain legal rights if any of our products are damaged or spoiled. You have rights relating to refunds and to have damaged or spoiled products replaced if realistically possible. Nothing in these Terms and Conditions affects these legal rights.

Refunds or exchanges, as applicable, will be provided where you have been charged for damaged and spoiled items, items that were not selected by you or your guests, or items that you had left in a prominent place or properly returned to a Connecté Store display.

If you have a problem with your bill or wish to request a refund or exchange, please approach one of our in-store representatives for assistance.

If you have damaged the item or opened its packaging while it is in your possession, we reserve the right to refuse to provide a refund or exchange.

Other Terms

The Connecté Store provides us and McGill University with information about your use of and presence in the Connecté Store. Any information we receive, use or disclose in relation to the Connecté Store features of the app, or the Connecté Store itself, will be subject to our Privacy Policy.

We reserve the right to change, modify, alter, add, remove or otherwise update these Terms and Conditions without prior written notice at any time, and from time to time, at our sole discretion.  We will notify you of any such changes, modifications, alterations or updates by posting notice of same within the app or on our website. Following the posting of any such notice, your continued use of the Connecté Store will constitute your acceptance of the new terms and conditions and any other term or policies referred to therein, and you will be bound by those new terms and policies.

We cannot guarantee that the functionality of the Connecté Store will be reliable or complete in all circumstances.  Any dispute or claim arising from or relating to these Terms and Conditions or the Connecté Store is subject to the Couche-Tard Terms of Use, including but not limited to the provisions governing dispute resolution, governing law, disclaimer of warranties, and limitation of liability.
