  1. DURATION

The Contest is held by the Organizers and takes place during the Period, online, on the Contest Page.

 

  1. Eligibility

This Contest is open to all Québec residents who are 18 years of age or older. Excluded are employees, officers, directors, mandataries, agents, and representatives of the Organizers, their affiliates, related companies, divisions, and subsidiaries, their advertising and promotional agencies, participating partners and merchants, their Prize, Contest material, and Contest services suppliers, as well as any other party involved in the holding of this Contest (hereinafter collectively referred to as the “Organizing Entities”), members of their immediate families (brother, sister, child, father, mother, or spouse), and all persons living with the aforementioned persons.

 

  1. METHOD OF ENTRY

To enter the Contest and have a chance to win a Prize during the Period, the participant must go to one of the participating Couche-Tard establishments in Québec and with the purchase of a Journal de Montréal (depending on product availability, while supplies last), the consumer has a chance to win one of two (2) daily prizes. They will hear the cash register ring (harp sound) if they are declared a winner. A cash register coupon will be given to the consumer to confirm the prize.

 

  1. LIMITATIONS

By entering the Contest, you agree to be bound by all of the Organizers’ decisions, which are final and binding in all respects, subject to the jurisdiction of courts of general jurisdiction, if applicable, and you agree to abide by the following limitations, failing which the Organizers reserve the right to cancel one or more Entries.

The terms and conditions of the gift card issuer apply, including those reproduced on the back or given to the winner. Not redeemable for cash, cannot be combined with any other offer.

  1. DRAW

The winners of the Contest will be selected by random draw on the Draw Dates at the Draw Location among the registered Entries in accordance with the Rules. The chances of an Entry being selected at random depend on the total number of Entries registered in the Contest in accordance with the Rules. 

 

  1. PRIZE CLAIM
    1. To be declared a winner and receive a Prize, the selected person must have
      (A) kept the cash register coupon and contacted Messageries Dynamiques at 450-663-9000 ext. 4243 or by email at karine.arcand@quebecormedia.com
      (B) responded to the Organizers' e-mail or telephone message within 24 hours of first being contacted by the Organizers
      (C) signed the declaration and release form (hereinafter referred to as the “Release Form”) and returned it to the Organizers within 48 hours of receiving it
      (D) complied with the conditions and deadlines for awarding Prizes as communicated by the Organizers following receipt of the Release Form.

 

  1. If any condition of the Rules is not met, the Entry of the person selected for a Prize will be canceled, after which the Organizers may cancel the Prize without any further formalities or liability.

 

  1. Without limiting the generality of the foregoing, the Organizing Entities decline all liability for: (A) any incomplete or inaccurate information, even if attributable to an error related to the Contest Page or any related platforms; (B) any technical failure, including of hardware, software, or total or partial inaccessibility of the Contest Page, for any reason whatsoever; (C) the unavailability of Internet networks or errors or delays in the transmission of Entries; (D) any unauthorized intervention, including human or robotic errors, during the Contest Period; (E) any error, including human or robotic errors, occurring during the processing of Entries; (F) any damage, including material damage, resulting from entering the Contest and acceptance or use of a Prize; (G) any Entry received late, lost, damaged, misdirected, illegible, or incomplete.

 

  1. GENERAL
    1. Acceptance of a Prize. Winners must accept any Prize as described in the Rules and may not transfer it to another individual, substitute it for another Prize, or exchange it for cash in whole or in part, except with the approval of the Organizers at their discretion. In any event, the Organizing Entities will not be liable to award more Prizes beyond those listed in the Rules. An Organizer is released from all obligations if a Prize winner refuses to accept the Prize in accordance with the Rules.

 

  1. Organizers' prerogatives. The Organizers reserve the right, at their discretion, to: (A) cancel, suspend, or modify the Contest or its Rules, in whole or in part; (B)cancel any Entry submitted in a manner that is contrary to, incorrect, or disrespectful of the Rules or that is unfair to other participants (e.g. entries exceeding the permitted limit, automated entries, computer hacking, etc.). The Organizers reserve the right to inform the appropriate police and judicial authorities.

 

  1. General conditions applicable to all Prizes. The Organizers reserve the right to: (A) replace all or part of the Prizes with another prize or part thereof of equal or greater value; (B) limit the number of Prizes awarded to any one person; (C) modify any component of the Prize; (D) issue additional conditions of awarding/using a Prize which may be modified at the discretion of the Organizers. The Prizes: (i) may differ from the images presented in the promotional material of the Contest; (ii) may be subject to additional conditions which must be met by the winner in order to win the Prize; (iii) only include what is explicitly indicated in the Rules as being included and, therefore, all costs, expenses, and fees not provided for in the Rules are the responsibility of the winner; (iv) must be accepted as awarded; (v) do not give rise to any compensation if not used in whole or in part; (vi) are subject to no warranty other than the legal warranty of the manufacturer, retailer, or Prize supplier, as the case may be.

 

  1. Limitation of liability. By entering or attempting to enter the Contest, any person releases, to the fullest extent permitted by law, the Organizing Entities from: (A) any liability for any damages that may result from the acceptance or use of the Prize; (B) any liability for late delivery, loss, or theft of Prizes, including at the time of and in connection with their delivery; and (Cany liability and damages that may result from entering or attempting to enter the Contest.

 

  1. Responsibility of Prize suppliers. Upon being declared a Prize winner, each winner acknowledges that the awarding and fulfillment of the Prize is solely the responsibility of the Prize supplier and that any claims related to the Prize must be made directly to the Prize supplier, with the Organizing Entities assuming no liability whatsoever for such claims. 

 

  1. Inability to act – labour dispute. The Organizing Entities assume no liability whatsoever and offer no compensation in all cases where their inability to act results from force majeure, a fact or situation beyond their control, a strike, a lock-out, or any labour dispute.

 

  1. Authorization. All winners authorize the Organizers, and any person authorized by them, to communicate with them for the purposes of the Contest. In addition, by entering the Contest, each participant authorizes the Organizing Entities, at their discretion, to use his/her name, photograph, image, statements regarding the Prize, place of residence, voice, and any material submitted in connection with the Contest, free of charge, and without limitation as to support, media, duration, language, or territory, for any purposes deemed relevant. 

 

  1. Organizers' decisions. Any decision of the Contest Organizers or their representatives regarding this Contest shall be final and without appeal, subject to the jurisdiction of courts of general jurisdiction, if applicable. 

 

  1. No affiliation. The Contest is in no way affiliated with, endorsed, presented, sponsored, or organized by any social network, including Facebook, Instagram, or TikTok. 

 

  1. Personal information. Any personal information provided to the Organizers for the purposes of the Contest is the property of its issuer and is provided for the purposes of administering the Contest in accordance with the Privacy Policy. No commercial or other communication unrelated to this Contest will be sent to the participants by the Organizers, unless the participant has consented to it prior to the Contest, has otherwise authorized it in their Entry, as the case may be, or as permitted under the Privacy Policy. Notwithstanding the foregoing, if you enter the Contest via a social networking platform (e.g. Facebook, LinkedIn, Instagram, TikTok, etc.) you accept that the Organizers may contact you via the messaging system of such platform to inform you if you have won a Prize or if proper management of the Contest requires it. 

 

  1. Language. In the event of any discrepancy between the French and English versions of the Rules, the French version shall prevail.
